Court Strikes Down Ban on 40 Bitcoin Sites in Russia

Regulation

Saint Petersburg City Court has struck down a ban on 40 bitcoin related websites offering information about cryptocurrencies and exchange services in Russia. The ban was imposed by a district court in May last year, following a request from the Prosecutor’s Office. It prohibited the “spreading of information” about bitcoin, as well as buying and selling cryptos.

Site Owners Win Important Battle

Court Strikes Down Ban on 40 Bitcoin Sites in RussiaIn what seems to be a small, but important victory for the Russian crypto community, the City Court of Saint Petersburg has struck down a ban that affected more than 40 websites related to bitcoin. It was imposed by a district court in May 2017, after a request from the Prosecutor’s Office in the Northern Capital of Russia. The measure effectively restricted access to the internet platforms and prevented the exchange services offered by some of them.

Following last year’s ban, the owners of the websites appealed the local judicial authorities’ decision in the second-largest Russian city. The Oktyabrsky District Court had stated that the spreading of information about bitcoin and the use of cryptocurrencies was illegal in the Russian Federation. Its decision was forwarded to the Russian telecommunications supervisory agency Roscomnadzor, which was supposed to blacklist the sites.

The Case to Be Reviewed by Other Judges

“The actual existence of a cryptocurrency outside the legal frame does not provide for the implementation of legal mechanisms to ensure that the parties fulfil their obligations”, decreed the first instance ruling. The regional court also noted that bitcoin was “not backed by real value” and its use was anonymous. It stated that the Russian ruble was the only official currency in the country, pointing out that emitting other currencies and money surrogates was prohibited.

According to the judges, the cryptocurrency “does not have a subject which guarantees its conditional purchasing power”. They were worried that “the emission and the circulation of bitcoins is completely decentralized” and there was no state regulation. The court warned that cryptocurrencies, like bitcoin, contributed to the growth of the shadow economy and could not be used by citizens and legal entities in the Russian Federation.

Now, the case will be returned to the Oktyabrsky District Court. According to Russian law, it should be reviewed again by a new judicial panel.

Moscow Still Working on Crypto Legislation

Court Strikes Down Ban on 40 Bitcoin Sites in RussiaAuthorities in the Russian capital are still preparing new legislation to regulate the cryptocurrency sector. A law on “digital financial assets” and crowdfunding has been proposed by the Ministry of Finance, despite disagreements with the Central Bank of Russia over the circulation and trading of cryptocurrencies. Many other drafts touching different aspects of the digital economy are also pending in the State Duma. There have been multiple calls to regulate cryptocurrencies in the Russian Federation. Recently, the head of the parliamentary Committee for Economic Policy Sergey Zhigarev proposed legalizing cryptocurrencies in order to attract foreign investments, as news.Bitcoin.com reported.

Federal institutions have been criticized over their slow progress. Interested parties and regional officials have called on the Russian government to catch up with other countries. The chairman of the Financial Market Committee in the Duma Anatoliy Aksakov said its members were trying to speed up the legal process and were ready to introduce the drafted legislation in the lower house of Russia’s parliament. Experts from the crypto sector have said that proposed regulations leave many issues unresolved and need revision before their final adoption.

Japanese Banking Group SBI Postpones Cryptocurrency Exchange Launch

Japanese financial services giant SBI Group has delayed the launch of its cryptocurrency exchange after determining it had to further strengthen security measures.

In an announcement this week, the SBI group confirmed the postponement of the launch of its cryptocurrency exchange, SBI Virtual Currencies, Japan’s first bank-owned cryptocurrency exchange. As reported by CCN in October 2016, SBI became the first banking group to announce the launch of a cryptocurrency trading platform. SBI Virtual Currencies was established as a new offshoot in November 2016, but the launch of exchange operations continues to see delays. The delays come despite completing its registration as a virtual currency exchange operator with the Financial Services Agency, Japan’s financial regulator, in late September 2017.

The group revealed that a select group of priority customers had already completed formalities to open an account at the platform but they, along with regular customers, will have to wait for an undetermined period of time for the launch of the trading platform.

Pointedly, SBI underlined the need for strengthening security measures as the reason for the delay.

In loosely translated statements, SBI said:

“We decided that it will take a certain amount of time to further strengthen security measures, how to manage [customer] assets under custody, and customer management system.’

The self-enforced delay notably comes on the heels of increased scrutiny by the FSA into cryptocurrency exchanges extending to on-site inspections by the regulator following the recent $530 theft from Tokyo-based cryptocurrency exchange Coincheck. Japan’s biggest cryptocurrency exchanges are also banding together to establish a self-regulatory body to comply with better security measures to safeguard investors against thefts.

SEC Targets ICOs in Broad Cryptocurrency Markets Investigation

While all may seem quiet on the regulatory front, it could just be the calm before the storm. The US Securities and Exchange Commission is pursuing a broad investigation into ICOs, one in which numerous subpoenas and requests for information have been issued to a number of blockchain startups, according to The Wall Street Journal. The SEC apparently wants insight into the moving parts that comprise both the ICO and the pre-sale leading up to the public crowdsale.

The securities regulator has been ratcheting up its talk on ICOs that it says may be in violation of securities laws, and now they are taking action. The BTC price was off about 3% soon in the moments after the WSJ report came out.

ICOs are a multi-billion dollar market, with tallies for last year ranging from $5.6 billion to as high as $6.5 billion. 2018 has been off to a bang as well, with deals such as Telegram targeting billions of dollars. SEC Chairman Jay Clayton said earlier this month: “I believe every token I’ve seen is a security,” which should have sent chills up the spine of the founders of blockchain startups that chose to label their tokens a utility and not a security.

A utility token should have a specific application tied to the ecosystem for that token sale. For example, a gaming project whose tokens can be used to purchase virtual goods. But few “utility” tokens are actually limited to the applications they were meant for. When investors begin to speculate on the value of the token itself, that’s where the gray area surfaces, which worries regulators.

Deal Structure

In the subpoenas, the SEC is reportedly requesting information from issuers such as the “structure” of both token sales and ICO pre-sales, according to the Journal. While both ICOs and initial public offerings (IPOs) are fundraising methods, the former is much more loosely regulated. ICO issuers disclose a white paper, comprised of details for how that project sees the world, and having to register with regulators would slow down the fundraising process.

Meanwhile, cybersecurity consultant John Reed Stark, a former SEC official, presciently told Bloomberg earlier this month that in addition to the ICO issuing companies, attorneys advising those startups that are found to be in violation of securities laws were similarly at risk of being part of a regulatory “sweep,” one that he predicted would focus on the “low hanging fruit” to start.

Regulators previously “recommended enforcement actions against those that conduct initial coin offerings in violation of the federal securities laws,” according to the SEC. The SEC last year made it the job of a new crypto-focused task force to examine new digital tokens that come to market, and they’ve stopped or spooked more than a handful of them so far that they’ve made public.

Las Vegas LocalBitcoins Trader Accused of Money Laundering

CEO of Bitcoin, Inc., Morgan Rockcoons was arrested by officials from U.S. Immigration and Customs Enforcement (ICE) at his home in Las Vegas, Nevada. He was charged with operating an unlicensed money transmitting business and money laundering according to the court records.

According to those records, in December 2017 Rockoons allegedly exchanged 10 Bitcoins (Worth $9,000) at that time for $14,500 in cash with an undercover law enforcement officer. The officer mentioned that the cash came from the manufacture and sales of “Hash Oil” which is a banned substance in the United States.

Since Rockoons knew the cash was dirty and helped the law enforcement officer acquire bitcoins for it, he was accused of laundering the money. Also, he was charged with running an unlicensed money transmitting business since the transaction was more than $10,000. Legitimate money transmitters are required to register with the Financial Crimes Enforcement Unit (FinCEN) by law if they’re facilitating transmits over $10,000, and Rockoons wasn’t registered.

A different side to the story

Rockoons, on the other hand, had an entirely different story in a series of tweets. He claims the law enforcement official said the money was for buying a medicinal hash machine and not that it was dirty money. Also, he claims the transaction was perfectly legal since the transaction took place in California and Cannabis is legal for both medicinal and recreational use in the state.

Rockoons said the buyer found him through LocalBitcoins, which is a peer-to-peer exchange for buyers and sellers to meet and transact Bitcoins. Then, the buyer insisted on paying him $14,500 for $9,000 worth Bitcoins to entrap him. So he received the money and sent Bitcoins worth less than $10,000 which he claims is still legal.

Rockoons insists that he never does any transaction above $10,000 and that he only did this one since he was in need of cash. He also claimed that the money was paid by cash in an envelope and the person had only contacted him through text messages.

Morgan Rockoons was locked up in jail for five days before he was released. He is fighting the charges in court and has taken to Twitter to ask donations for his legal fees which he expects to be around $150,000 – $300,000. He’s been trying to appeal to the community, by calling his case an attack on Bitcoin. He’s already received some donation, and he intends to pay his lawyers in Bitcoin.

Though Rockoons took to Twitter to tell his side of the story, not everyone is buying it. Some people feel he should’ve known something was wrong here when someone offered to pay him $14,500 for Bitcoins worth just $9,000.

This is not the first time a US law-enforcement agency has tried entrapping LocalBitcoin sellers. In fact, in October last year, a Michigan man was imprisoned for selling Bitcoins worth more than $56,000 to law enforcement agents. The only difference here is that Rockoons denies any wrongdoing and is determined to fight it out in the court.

Offshore Tax Haven Marshall Islands to Issue National Cryptocurrency

Altcoins

A small island nation with less than 60,000 inhabitants best known internationally as a former test site for nuclear weapons is joining the hottest new trend – issuing a national cryptocurrency. The planned Marshall Islands’ Govcoin is expected to be issued later this year.

Marshall Islands Govcoin ICO

The Republic of the Marshall Islands plans to issue its own cryptocurrency as an official legal tender, to be known as the Sovereign. The local parliament voted this week to proceed with the issuing plan, Kenneth Kedi, a senator and the body’s speaker, said in a Bloomberg interview. A council still has several days to object, a step he considers unlikely.

The Sovereign is expected to be issued later this year, David Paul, minister-in-assistance to the president revealed. The Marshall Islands government will arrange an initial coin offering (ICO) and exchanges will be allowed to apply to trade the currency, he said. The move is seen as a way to bolster local budgets, he added. “This was specifically targeted for the long-term needs of the country.” A portion of the funds raised in the ICO offering will also be used to finance health care to islanders still affected by US nuclear weapons testing in the area decades ago, Paul said.

The National Crypto Trend

Offshore Tax Haven Marshall Islands to Issue National CryptocurrencyThere have been discussions for the last few years among central bankers about issuing national cryptocurrencies, mainly as an effort to to create a ‘cashless society’ or to try and answer the attraction to bitcoin by young people, as they see it. However, this trend has gotten a lot stronger recently, apparently because of the government of Venezuela pushing its own Petro.

The actual potential value of such national cryptocurrencies is still in doubt. For citizens, these digital currencies will not offer the alluring freedom from state control of bitcoin if they are really managed by the government. And if they are not run by the state then they will offer no benefit to central bankers. As the Russian Ministry of Finance recently informed President Vladimir Putin, the creation of a centralized coin seems impossible, as cryptocurrencies are based on decentralized ledgers.

Why do you think so many countries around the world are now considering issuing their own altcoins? Share your thoughts in the comments section below!
